132014-06-23 ELECTRONIC ORDER, granting pursuant to Local Rule 7(b) of Civil Procedure, 11 First Motion for Extension of Time to Respond to Complaint by Defendant Wells Fargo Bank, N.A. ("Wells Fargo"). In general, a defendant in a civil case may, upon motion, obtain from the Clerk an initial extension "not to exceed 30 days" with respect to "the date for filing an answer or motion addressed to the complaint...." D. Conn. L. Civ. R. 7(b)(1)(a). All other extensions must be decided by the Court; and the party seeking the extension must demonstrate "good cause" for the extension by making "a particularized showing that the time limitation in question cannot reasonably be met despite [that party's] diligence...." Id. 7(b)(2). In the present circumstances, Wells Fargo may be granted this initial 30-day extension upon request pursuant to Rule 7(b)(1). In addition, Wells Fargo has presented facts to support "good cause" for the requested extension in that "Wells Fargo requires additional time to investigate the claims of the Complaint and to prepare an appropriate responsive pleading" in light of "the complexity of the issues" and the numerous alleged bases for the claims "the Complaint raises" (e.g., "fifteen separate bases for his CUTPA claim," "regulatory compliance issues under federal law"). Doc. 11 , p. 2. The Court is mindful of Plaintiff's objection to 18 of the 30 days requested due to his asserted "ongoing [financial] harm" resulting from Wells Fargo's alleged payment of "$100 less [per month] than provided in the loan document" relating to the reverse mortgage loan at issue. See Doc. 12 . However, this litigation will proceed in the interest of justice, and most expeditiously for both parties, if Defendant is allowed sufficient time to investigate and assess the claims presented before responding. Only then will both parties know which matters are truly in dispute in this action. Wells Fargo is advised that the Court may also bear in mind, weighing as a factor for consideration, prejudice to Plaintiff if the Court is presented with future motions for extension. See, e.g., Kassner v. 2nd Avenue Delicatessen Inc., 496 F.3d 229 (2d Cir.2007) (in determining whether "good cause" for an extension in scheduled deadlines exists, in addition to the "primary determinant" of the moving party's diligence, district court may also consider "other relevant factors," including "whether allowing the [extension] at this stage of the litigation will prejudice [the non-moving party]."). See also United States v. Cohan, No. 3:11CV412 (CSH), 2012 WL 4758142, at *2 (D.Conn. Oct. 5, 2012) ("[t]he court may also consider whether the amendment [of the scheduling order] will prejudice the non-moving party"). At this time, Wells Fargo's motion for extension is GRANTED.
