262013-07-11 OPINION & ORDER re: 14 MOTION to Dismiss the Amended Complaint . filed by Eric K. Shineski. For the reasons set forth above, defendant's motion to dismiss McManamons discrimination and retaliation claims under Title VII, the ADEA, and the Rehabilitation Act is granted. Defendants motion to dismiss McManamons defamation claim is also granted. To the extent that defendant moves to stay discovery, see Dkt. 21, that motion is denied as moot. The Clerk of Court is directed to termina te the motion at docket number 14, and to close this case. The Court certifies, pursuant to 28 U.S.C. § 1915(a)(3), that any appeal from this order would not be taken in good faith, and therefore in forma pauperis status is denied for the purpose of an appeal.
