12013-07-22 Order from Second Circuit Court of Appeals transferring this action to the Western District of New York. (JMM) (Entered: 07/22/2013)
22013-07-22 Petition originally submitted to the Second Circuit Court of Appeals. (JMM) (Entered: 07/22/2013)
32013-07-22 TEXT ORDER: on or before August 8, 2013, the parties shall inform the Court, in a short filing, jointly, if possible, of their views whether factual information necessary for the hearing has been sufficiently developed so as to permit scheduling the hearing without necessity of adjournments and, if not, what pre-hearing proceedings are necessary. The parties are advised that the Court is likely to require that they file, well in advance of the hearing: (1) pre-hearing memoranda setting forth all applicable legal standards, detailed statements of material undisputed and disputed facts, and analyses of evidentiary issues that may arise during the hearing; (2) witness lists with short descriptions of the subjects of expected testimony and the likely time for completion of direct examination; (3) exhibit lists; (4) such stipulations of fact and law as the parties agree upon. Finally, the parties are directed to contact Chambers to schedule a status conference on August 15, 2013. Issued by Hon. Richard J. Arcara on July 22, 2013. (WJG) (Entered: 07/22/2013)
