John W . Stewarq proceeding oro K, filed a civil rights complaint, ptlrsuant to 42 U.S.C. j

1983 . By Order entered 6/12/2013, the court directed plaintiff to subm it within 10 days from

the date of the Order his inmate account statem ents for the six-m onth period im mediately

preceding the filing of his com plaint. Plaintiff was advised that a failure to comply would result

in dismissal of this action without prejudice.

M ore than 10 days have elapsed, and plaintiff has failed to comply with the described

conditions because he has not return the requested financial inform ation. A ccordingly, the court

dismisses the action without prejudice and strikes the case from the active docket of the court.

Plaintiff m ay retsle the claim s in a separate action once plaintiff is prepared to comply with the

noted conditions.

The Clerk is directed to send a copy of this M em orandum Opinion and accom panying

Order to plaintiff.
